The default pointed out by the Registry has been removed by filing the statement of the witnesses examined before the trial Court, copy of the charge sheet and other annexed documents barring the default pointed out dated 07-08-2015. On due consideration, default No.1 pointed out dated 0708-2015 is hereby overruled. Heard on the instant Cr.M.P. followed by acquittal appeal as they are within limitation.

For the purposes of leave to appeal, impugned judgment, copy of the statement of witnesses adduced during the trial and other material perused.

In the considered view of this Court, this is a fit case where leave to appeal be granted.

Consequently, the instant Cr.M.P. is hereby allowed and leave to appeal is granted.

Registry is directed to register the matter under the head of Acquittal Appeal.

Record of the Court below be called for through usual mode and fax mode.

The appellant is directed to pay P.F. within 7 days from now. Let notice be issued to the respondent through usual mode and registered mode, returnable within 4 weeks, for the purposes

of his representation in the matter.
