(1) This is the second bail application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.130/2015 registered at Police Station Kasdool, Police Chouki Lawan, for the offence punishable under Sections 376 of the Indian Penal Code and Sections 4, 6 & 10 of the Protection of Children from Sexual Offences Act, 2012. (2) The applicant's first bail application was dismissed as withdrawn with liberty to file the same after examination of the material
prosecution witnesses by order of this Court dated 04.05.2015 passed in M.Cr.C. No.1798/2015.
(3) The second bail application has been filed without examination of all material prosecution witnesses, as such, the present second bail application cannot be entertained in view of order dated 04.05.2015. (4) The applicant is at liberty to file bail application after examination of all the material prosecution witnesses as directed earlier. (5) The instant bail application as framed and filed is dismissed reserving liberty in favour of the applicant. Certified copy as per rules.
