Upon due consideration, delay in filing application is condoned. Taking into consideration the submission of learned State counsel that despite categoric evidence of the prosecutrix proceeded by written report and the delay in lodging FIR explained in the evidence of the prosecution witnesses including prosecutrix, acquittal has been ordered, we are inclined to grant leave to appeal. Let appeal filed by the State be registered as acquittal appeal and be listed for further orders.
