1. The petitioner has filed the present writ petition seeking for a direction to the respondent no.1 & 2 to take appropriate decision on the claim of the petitioner for compassionate appointment on the death of her husband Gajendra Kansari.

According to the petitioner, the deceased Gajendra Kansari I.e the husband of the petitioner was working as an Assistant Teacher(L.B.) at the Primary School Onava, Block Chura, District Gariyaband. He died in harness on 10.05.2021. Immediately thereafter the petitioner has moved an application for compassionate appointment. The petitioner now has come to know that respondent no.3 the sister of the deceased employee
-2has also moved an application claiming compassionate appointment. According to the petitioner the sister of the deceased i.e. the respondent no.3 is an already married lady and staying in her matrimonial home along with her husband and that in any case the petitioner being the widow of the deceased she has a claim for compassionate appointment first. The petitioner prays that respondents may be directed to take a decision on her application on its own merits in accordance with law at the earliest.

The limited grievance that the petitioner has and also taking note of the fact that claim of the petitioner has till date not been finalized, accordingly the writ petition can be disposed of directing the respondent no.1 & 2 to take appropriate decision on the claim for compassionate appointment moved by the petitioner at the earliest strictly in accordance with rules and regulations governing the field and policy of the compassionate appointment applicable after due verification so far as entitlement part is concerned.
4. Let an appropriate decision be taken at the earliest preferably within four months from the date of receipt of copy of this order. 5.
With the aforesaid observations, the present writ petition stands disposed off.
