The applicant has preferred this application for grant of bail as he is arrested in connection with Crime 13/2020 registered in Police Station Korondha, Balrampur-Ramanujganj C.G. for offence punishable under section 304 of IPC & 135 of Electricity Act.

As per the prosecution case, on 15/06/2020 the deceased Khavo Khes came in contact of the live wire which was laid down by the applicant Subedar Ram in his field to run the water motor. 3.

Learned counsel for the applicant submits that the applicant has not committed any offence and it is for the fault of the deceased she came in contact with the live wire. He referred to statement of Prabhu Khes and would submit that the applicant may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail and he referred to the statement of Birbal. He would submit that charge sheet has been filed.

Considering the nature of offence and the allegation and the fact that charge sheet has been filed, the applicant is in jail since 17/08/2020,

this court is inclined to release the applicant on bail. 6.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
