This is the First Bail Application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested on 26.07.2020 in connection with Crime No.189/2020 registered at Police StationUrga, District Korba for the offence punishable under Section 420, 409 and 120-B read with Section 34 of Indian Penal Code, 1860. 3.

As per the prosecution case, on a complaint being made that the applicant along with other co-accused invited application for providing job at Shree Hospital Nursing & Para Medical College and having been received the application, huge amount was collected by the accused and the allegation is

that the applicant has also paid an amount of Rs.80,000/- and was working as Agent to bring other desirous people to be appointed. 4.

Learned counsel for the applicant submits that the applicant himself has been cheated and he was given appointment after payment of money, which reveals from Annexure P-2. He further submits that the charge sheet has been filed and the other similarly placed co-accused have been enlarged on bail, therefore, the applicant may be released on bail.

Per contra, learned State counsel opposes the prayer for grant of bail. 6.

Taking into the facts and nature of allegation against the applicant and considering the fact that the charge sheet has been filed, I am inclined to release the applicant on bail.

Accordingly, the bail application is allowed and the applicant is directed to be released on bail on executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the trial Court.
