Order On Board 18/08/2015 Heard.

1. This application under Section 438 of Cr.P.C. has been filed by the applicant apprehending his arrest in connection with Crime No. 01/2015, registered in Police Station -Ramchandrapur, District- Balrampur, Ramanujganj, for alleged commission of offence under Sections- 420, 467 and 471 of the IPC.

2. Case of the prosecution, in brief, is that the applicant obtained employment on the basis of forged mark-sheet.

3. Learned counsel for the applicant submits that the allegations are unfounded. He submits that earlier, inquiry was made and the Chief Executive Officer found that the the complaint is false.

4. On the other hand, learned counsel for the State submits that during investigation, report was obtained by the police from the Board as well as from the concerned Institution and both have written that the applicant never appeared as student in any examination.

5. Taking into consideration the submissions made by learned counsel for the parties, considering the nature of allegation, I am not inclined to allow the application.

6. The application is accordingly rejected.
