The applicant has preferred this first bail application under Section 439 of the Code of Criminal Procedure for grant of bail as he was arrested on 18.12.2019 in connection with Crime No. 428/2019, registered in Police Station Mujgahan Raipur (C.G.) for offence punishable under sections 457 and 380 of the IPC.

As per the prosecution case, the report was made by Smt. Mala Prasad that on 05.11.2019 the applicant entered into her house and thereafter committed theft of cash, silver ornaments and other household articles. 4.
Learned counsel for the applicant submits that the applicant is in jail since 18.12.2019, chargesheet has filed filed and no further investigation is necessary and he may be enlarged on bail.

Learned State counsel opposes the submission made by learned counsel for the applicant and submits that there are other six incidents to his credit.

Considering the fact that the applicant is in jail since 18.12.2019 and the chargesheet has also been filed, I am inclined to release the applicant on bail. Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed. 7.
