1. Heard.

2. This is the First Bail Application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested on 09.07.2021 in connection with Crime No.271/2021 registered at Police Station City Kotwali, Dhamtari, District Dhamtari (CG) for the offence punishable under Section 21 (C) NDPS Act.

3. As per the prosecution case, on a raid being conducted from the present applicant 3312 tablets of Tramadol Tablets were seized which were having the narcotic substance.

4. Learned counsel for the applicant submits that the seizure witnesss have been examined and they have not supported the case of the prosecution and the I.O. in this case is likely to be examined, therefore, the applicant may be released on bail.

5. Per contra, learned State counsel opposes the prayer for grant of bail.

6. Considering the fact that the trial is at the fag end at this stage I am not inclined to entertain the entire evidence on merit as any finding by this Court may affect the trial. In view of this the bail application is disposed of. SD/Sd/- Goutam Bhaduri Judge Ashu
