This is second bail application. First bail application was dismissed as withdrawn.

The applicant has been arrested in connection with Crime No.101 of 2020 registered at Police Station- Hasaud, District Janjgir Champa (CG) for the alleged commission of offence under Section 120-B, 420, 467, 468, 471 of IPC.

Case of the prosecution is that present applicant and co-accused hatched conspiracy to cheat the complainant and many other persons desirous of seeking public employment and the allegation is that present applicant is one who is alleged to have taken the money.

Learned counsel for the applicant would submit that the other co-accused of the case have already been granted bail by this Court vide order dated 25.08.2020 in M.Cr.C. No.3844 of 2020. He would next submit that the applicant is in jail since 02.06.2020 and investigation is complete and chargesheet has also been filed, therefore, at this stage, present applicant may also be granted bail.

On the other hand, learned counsel for the State opposes the bail application

and submits that the other accused persons, who have been granted bail stand on a different footings. He would submit that there is specific allegation of taking money against the present applicant. 6.

Taking into consideration the submission of learned counsel for the parties, particularly taking into consideration the nature of allegation, role alleged to have been played by the present applicant, at this stage, I am not inclined to grant bail to the applicant.

The bail application is therefore rejected.

However, in case, trial does not commence/conclude early, the applicant would be at liberty to revive the application after three months. Sd/- (Manindra Mohan Shrivastava) Judge Rekha
