1. Heard.

2. This is an application filed under Section 438 of the Code of Criminal Procedure for grant of anticipatory bail to the applicant, who is apprehending his arrest in connection with Crime No.155/2020 registered at Police Station Vishrampur, District Surajpur (CG) for the offence punishable under Section 376 of the IPC.

3. The applicant and the prosecutrix fell in love in the year 2007. When the prosecutrix attained the age of 19 years in the year

MCRCA No. 1321 of 2020 2012, she was subjected to sexual intercourse on promise to marry, which continued before lodging of the FIR. The applicant subsequently avoided and refused to marry the prosecutrix. According to the prosecutrix, the applicant wanted to marry some other girl, therefore, she had no other option but to lodge the FIR.

4. Considering the nature of allegations, this Court is not inclined to extend the benefit of Section 438 of Cr.P.C. to the applicant.
