Proceeding Through Video Conferencing Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 02/11/2020 :

1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.210/2020 registered in Police Station Pipariya, District Kabirdham for offence under Section 307, 294 and 506/34 of the IPC.

2. On account of playing Chhattisgari song on the sound system during prayers at Mahadev Temple, village Bodhaikunda, a fight broke out wherein accused Surendra caused injuries on the abdomen of victim Shailendra Verma by means of knife whereas the present applicant and

the third accused have also allegedly assaulted the victim by means of hands and fists.

3. Considering the role played by the present applicant in causing injuries only by hands and fists and for the fact that the applicant is in jail since 21.8.2020 and charge sheet has already been filed, this Court is inclined to release the applicant on bail.

4. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
