1. The applicant has preferred this application for grant of anticipatory bail as he apprehends his arrest in connection with Crime No.190/2020, registered at Police Station Lailunga, District Raigarh for offence punishable under Section 306 of the IPC.

2. The applicant used to commit physical cruelty on his wife in a state of intoxication forcing her to bring money from her parental house. As soon as the funds got exhausted, she was again asked to bring more money from her parents. Faced with this situation, the deceased committed suicide by consuming poisonous substance.

3. Considering the nature of allegations and the material available in the case diary, I am of the opinion that it is not a fit case for exercising power under Section 438 of the CrPC to release the applicant on anticipatory bail. Accordingly, the Application is rejected. However, if the applicant surrenders and applies for regular bail before the jurisdictional Sessions Court under Section 439 CrPC, the same shall be considered and decided expeditiously.
