Learned counsel for the petitioner would submit that lease granted on the tank has been cancelled by respondent No.4 without affording an opportunity of hearing to the petitioner. 2.

Mr.Dheeraj Wankhede, learned Government Advocate appearing for the State, would submit that order dated 16.1.2013 (Annexure P/10) passed by respondent No.4 is appealable before the Commissioner.

Be that as it may, the petitioner is free to prefer an appeal before the concerned Commissioner within a period of 30 days from today. If such an appeal is filed, the concerned Commissioner would do well and dispose off the same within a period of three months from the date of filing of the appeal after hearing all the affected parties.

With the aforesaid observation, the writ petition finally stands disposed off. No order as to cost(s).
