The applicant has preferred this application for grant of bail as he is arrested in connection with Crime 72/2019 registered in Police Station Dhaurpur, Ambikapur, District Surguja (C.G.) for offence punishable under sections 294, 323, 506, 307 of Indian Penal Code. 2.
As per the prosecution case, on a trivial dispute the applicant assaulted his father-in-law with spade on 22/11/2019, thereby offence has been committed. Thereafter the applicant was arrested on 25/11/2019. 3.
Learned counsel for the applicant submits that on a trivial dispute the incident happened, there was no intention to kill as the incident happened in between the son-in-law and father-in-law and the father-inlaw was assaulted, charge sheet has been filed and no further investigation is necessary, only for one day the victim was in hospital from 22/11/2019 to 23/11/2019, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.
Considering the back ground of the case, the nature of allegation
and the fact that the applicant is in jail since 25/11/2019, charge sheet has been filed, this court is inclined to release the applicant on bail. 6.
Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
