Hon'ble Justice Shri Gautam Chourdiya Order on Board 08/01/2021 1) The applicant has preferred this application under Section 439 of Code of Criminal Procedure, 1973 as he is in custody since 10/08/2020 in connection with Crime No. 40/2020 for the offence punishable under Sections 294, 506, 323, 307, 34 of the IPC registered at Police Station Punjipathra, District- Raigarh (C.G.). 2) At the very outset, learned counsel appearing for the applicant, on instructions seeks to withdraw this application with liberty to file a fresh application as and when occasion arises. 3) Accordingly, the application is disposed of as withdrawn with the liberty as stated above.
