Hon'ble Shri Justice P. Sam Koshy Order on Board 01/07/2019
1. The grievance of the petitioner in the present writ petition is the cancellation of the order of deputation in favour of the petitioner and sending her to the parent department.
2. The contention of the petitioner is that, the petitioner has been sent on deputation under the respondent No.4 on 25.04.2017. According to him, It is only two years of deputation period that the petitioner has completed and the period could be extended for another two years. The authorities concerned ought to have considered granting the petitioner extension of time for another two years period as the tenure of the deputation could be maximum of four years.
-23. Perusal of record would show that the petitioner has made representation for extension of deputation period on 20.06.2019 but till date no decision has been taken.
4. Given the facts that the petitioner is a widow and that her services could be extended on deputation for a further period of two years, this court is of the opinion that let the petitioner make a fresh representation within a period of seven days to the respondents No.2 to 4, who in turn shall consider granting extension of deputation period of the petitioner in accordance with rules governing the field within a further period of 30 days from the date of receipt of representation. Till then, the effect and operation of the order dated 18.06.2019 may not be given effect to, if the petitioner till date has not been relieved from the present place of posting. 5.
