The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.149/2020 registered in Police Station Nawagarh, Distt. Bemetara (C.G.) for offence punishable under sections 308, 304-A of Indian Penal Code.

As per the prosecution case, on 17/06/2020 the applicant who was driving the tractor knowing fully well ran over three motor cycles whereby three persons were injured and one Abhay died. 3.

Learned counsel for the applicant submits that the incident is of road accident, there was no intention to cause death and charge sheet has been filed. Under these circumstances, the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Considering the facts, nature of offence and the applicant is in jail since 19/06/2020, this court is inclined to release the applicant on bail. 6.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of

Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
