This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant, who has been arrested in connection with Crime No. 152/2015, registered at Police Station Dharsiwa, District Raipur (C.G.), for the offence punishable under Sections 363, 366, 376 of Indian Penal Code and Section 4 of Protection of Children from Sexual Offence Act,2012.

Case of the prosecution, in brief, is that, applicant has allegedly abducted minor prosecutrix and committed forcible sexual intercourse with her on 31/05/2015 and thereby committed offence. 3.

After hearing learned counsel appearing for the parties and taking into consideration the nature and gravity of offence and further considering the manner, in which applicant is alleged to have kidnapped minor prosecutrix

who is aged about 16 years and applicant is said to have committed forcible sexual intercourse with her, this Court is not inclined to release the applicant on regular bail.

Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected.
