1. These are the first bail applications filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicants in connection with Crime No. 108/2020 registered at Police Station Mohla, Distt. Rajnandgaon (C.G) for the offences punishable u/ss 406, 409, 420, 467, 468, 34 of IPC. Since all the bail applications are relating to the same crime number, they are being disposed of by this common order.

2. As per the prosecution case, applicant Ramhauram who was working as Manager and applicant Sonauram who was President of Laghu Vanopaj Sahakari Samiti, Gotatola, at the connivance of other accused Loknath, Manish Kumar & Milind Gajbhiye have deposited six cheques and withdrew a total sum of Rs.22,50,000/- in between 01.03.2019 to 31.10.2019 from the bank account of Laghu Vanopaj Sahakari Samiti,

Gotatola.

3. Learned Counsel for the Applicants would submit that the evidence available in this case is documentary in nature . He further submits that the charge sheet has been filed; seizure/recovery has been made; no further evidence is required in this case and the applicants are in jail since 06.09.2020, therefore, they may be enlarged on bail.

4. On the other hand, learned State Counsel opposes the bail applications and submits that the applicants have misappropriated the amount by transferring into their accounts.

5. Considering the fact that the charge sheet has been filed, the applicants are in jail since 06.09.2019 and the evidence available in these cases is documentary in nature I am inclined to release the applicants on bail.

6. Accordingly, the bail applications are allowed and the applicants Ramhauram, Sonauram, Maneesh Kumar Kathane, Loknath & Milind Gajbhiye are directed to be released on bail on each of them executing a personal bond in sum of Rs.25,000/- with one surety each in the like sum to the satisfaction of the concerned trial Court for their appearance before the said Court as and when directed.
