The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.237/2015 {ST No.63/2015 pending in the Court of Sessions Judge, Bemetara}, registered at Police Station City Kotwali, Bemetara, Distt. Bemetara, for the offence punishable under Section 302 read with Section 34 of the IPC.

2. Learned counsel for the applicant seeks to withdraw this application, as the applicant has already filed M.Cr.C.No.4314/2015 on 5-8-2015.
