Referring to the order passed in WPC No.1518/2016, learned counsel for the petitioners would submit that the petitioners are entitled for a better accommodation than the accommodation offered to them under the BSUP Scheme, because the said houses are small comparing the petitioners' requirement for 6 members of the family.

Shri H. B. Agrawal, learned Senior counsel appearing for the Municipal Corporation, Raipur and Shri P. N. Bharat, learned Addl. AG would submit that the petitioners have been offered houses under the BSUP Scheme like other leaseholders, even though the petitioners were not having any lease in their favour and were rank encroacher. They would submit that the respondents are ready and willing to offer flat under the BSUP Scheme to the petitioners, which they may occupy within the time allowed by the Municipal Corporation on payment of usual charges, as has been made applicable to other similarly placed persons.

In view of the statement made by the learned counsel for the respondents, nothing survives for adjudication in this writ petition. It is accordingly disposed of.
