This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant, who has been arrested in connection with Crime No. 60/2015, registered at Police Station Darima, Distt. Sarguja (C.G.), for the offence punishable under Section 376(2)(dha) of IPC and Section 4, 5(L), 6 of the Protection of Children from Sexual Offences Act, 2012.

After hearing learned counsel appearing for the parties and taking into consideration the nature and gravity of offence and the manner, in which, applicant is alleged to have committed forcible sexual intercourse with the minor prosecutrix, who is said to be 15 years on the date of offence, this Court is not inclined to release the applicant on regular bail. 3.

Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected.
