1. The claim of the petitioner in the present writ petition is for granting benefit of revised pay scale as also for granting benefit of Kramonati which the petitioner has become entitled for in the light of the length of the service that the petitioner has put in.

2. According to the petitioner, she has been initially appointed as Shiksha Karmi Grade-III vide order dated 14.06.2005 and on which she gave joining on 20.06.2005. She has now been absorbed in the Education Department on 10.08.2018 and has put in more than 14 years of service by now and as such is entitled for the benefit of revised pay scale as well as Kramonati considering the length of service that she has put in.

-23. The State Govt. had meanwhile issued certain circulars on 02.11.2011 and 17.05.2013 so far as granting of revised pay scale as well as granting of Kramonati is concerned.

4. It appears that the petitioner has not made the Chief Executive Officer, Janpad Panchayat, Fingeshwar under Zila Panchayat, Gariyaband, as party respondent. It is the Chief Executive Officer, Janpad Panchayat, Fingeshwar who is a competent authority for releasing the aforesaid two reliefs as the petitioner has completed eight years of service while serving Panchayat Department well before her absorption to the Education Department.

Given the aforesaid facts and circumstances of the case, let the petitioner make a detailed representation to the Chief Executive Officer, Janpad Panchayat, Fingeshwar at the earliest preferably within a period of 15 days who, in turn, shall consider the claim of the petitioner for grant of revised pay scale and Kramonati and issue necessary correspondence/order in this regard to the District Education Officer, Gariyaband for necessary compliance of the same.

Let the Chief Executive Officer, Janpad Panchayat, Fingeshwar, take a decision within a period of 60 days from the date of receipt of representation to be made by the petitioner and thereafter the District Education Officer is expected to take a decision promptly from the date he receives an order/communication in this regard by the Chief Executive Officer, Janpad Panchayat, Fingeshwar.
