This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.2/2015, registered at Police Station-Lemru, Distt.Korba (CG), for the offence punishable under Sections 363, 366A, 370, 370A, 373 & 376/34 of the IPC, Sections 4 & 6 of the Protection of Children from Sexual Offences Act, 2012 and Section 3 (2) (v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. 2.

Taking into consideration the facts and circumstances of the case; further taking into consideration the nature and gravity of offence; the manner in which the applicant has kidnapped and taken the minor prosecutrix in his vehicle and role of the present applicant in offences in question, this Court is not inclined to release the applicant on regular bail.

Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected.
