(1) The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during trial in connection with Crime No.204/2014 registered at Police Station Seetapur, Distt. Surguja for the offences punishable under Sections 304-B/34 & 302/34 of the Indian Penal Code.

(2) Taking into consideration the facts & circumstances of the case; and in view of the rejection of the bail application of the other similarity situated co-accused persons; and considering the dying declaration of the deceased; I am not inclined to release the applicant on bail. Thus, the bail application is rejected. Certified copy, as per rules.
