1. The applicant has preferred this application u/s 439 of Cr.P.C. for grant of bail as he is arrested on 23.06.2020 in connection with Crime No. 30/2020 registered at Police Station Ghumka District Rajnandgaon (C.G.) for offence punishable under sections 1351(A), 139, 137, 140 of C.G. Electricity Act.

2. As per the prosecution case copper wire to the extent of 17 kg was seized in crime No. 111/ 2020 and allegation against the applicant is that the applicant knowing the fact that the copper wire has been stolen from the transformer has purchased the same, thereby different crimes has been registered.

3. Learned counsel for the applicant would submit that charge sheet has been filed and no further seizure would be required. He further submits that the applicant is in jail since 23.06.2020 and further investigation would take time, therefore, the applicant may be enlarged on bail.

4. Learned State counsel opposes the prayer for grant of bail.

5. Taking into the nature of allegation, and further considering the facts that seizer has already been made and charge sheet has already been filed, I am inclined to grant bail. Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
