The accused/applicant has moved this second bail application under Section 439 of the Code of Criminal Procedure, 1973 for release him on regular bail during trial in connection with Crime No.115/2020, registered at Police Station-Kotwali, Raipur, Distt.Raipur (CG), for the offence punishable under Section 20(B) of the Narcotic Drugs and Psychotropic Substance Act, 1985. 3.

At the outset, Mr.Pawan Kesharwani, learned counsel for the applicant would submit that he is not pressing this bail application on merits and only confines his submission for grant of temporary bail as the applicant's maternal uncle Mohd. Salim has died on 7.9.2020 and his 40th ceremony is to be held on 20.10.2020 and for which presence of the present applicant is absolutely necessary.

On the other hand, Mr.Ravi Bhagat, learned Deputy Government Advocate for the State, formally opposes the prayer for grant of temporary bail.

I have heard learned counsel for the parties and perused the documents appended with the bail application. 6.

Considering the fact that 40th ceremony of the applicant's material uncle is to be held on 20th October, 2020, it is directed that the applicant shall be released on temporary bail on his furnishing bail bond of ₹ 25,000/- with one surety in the like amount to the satisfaction of the trial Court on or before 19th October, 2020 and he shall surrender before the trial Court on 22nd October, 2020.

The second bail application is accordingly disposed of. 8.
