1. The applicant has preferred this application u/s 439 of Cr.P.C. for grant of bail as he is arrested on 12.04.2020 in connection with Crime No. 39/2020 registered at Police Station Bagicha District Jashpur (C.G.) for offence punishable under sections 302, 201 of IPC.

2. As per the prosecution case on 12.04.2020, the applicant on a dispute with his wife strangulated her wife, thereafter, in order to make disappearance made her body hang.

3. Learned counsel for the applicant would submit that on a trivial issue when the husband went outside, the wife hanged herself and committed suicide and thereby the applicant has not committed any offence, therefore, the applicant may be enlarged on bail.

4. Learned State counsel opposes the prayer for grant of bail and refers to postmortem report wherein the cause of death is shown as throttling.

5. Considering the postmortem report and the place were the incident happened and further considering the extra judicial confession made by the applicant before the mother of deceased, I am not inclined to grant bail.
