This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.95/2013, registered at Police Station-Shankargarh, District-Balrampur-Ramanujganj (C.G.), for the offence punishable under Sections 363, 366(A), 370, 367, 366, 376 and 120B/34 of the IPC.

Case of the prosecution, in brief, is that, on 14.6.2003 Malo Bai and Sanju Toppo went missing. It is also case of the prosecution that co-accused Smt.Shanti Devi and Surendra kidnapped them and sold Malo Bai with the present applicant and he committed sexual intercourse with her. 3.

After hearing learned counsel appearing for the parties, taking into consideration the material available on record, the manner in which the minor Malo Bai was kidnapped and subjected to sexual intercourse and the material

available with regard to human trafficking, this Court is not inclined to release the applicant osn regular bail.

Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected.
