1. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.34/2015 {ST No.89/2015 pending in the Court of Additional Sessions Judge, Kondagaon}, registered at Police Station Vishrampuri, Distt. Kondagaon, for the offence punishable under Section 376 (2) (d), 450 & 457 of the IPC.

2. Learned counsel for the applicant seeks to withdraw this application with liberty to repeat after examination of material prosecution witnesses.
