(2) Learned counsel appearing for the petitioner seeks permission of this Court to withdraw the instant petition with liberty to file an application under Section 439(2) of the Code of Criminal Procedure before the Court of Sessions, who has granted anticipatory bail to the respondent No.2.

(3) Permission is granted.

(4) Accordingly, the instant petition is dismissed as withdrawn with the liberty as aforesaid.

(5) The certified copy of the order impugned be returned to the learned counsel for the petitioner, after furnishing an attested photocopy thereof.
