The applicant has preferred this first bail application under Section 439 of the Code of Criminal Procedure for grant of bail as he is arrested on 23.06.2020 in connection with Crime No. 17/2020, registered in Police Station Ghumka Distt. Rajnandgaon (C.G.) for offence punishable under sections 135(1)(A), 139, 137 & 140 of the Chhattisgarh Electricity Act. 3.
As per the prosecution case, the applicant has purchased the copper wire and other articles which are being used in the transformer, which was stolen, thereby has committed the offence. 4.
Learned counsel for the applicant submits that the applicant is in jail since 23.06.2020, the chargesheet has been filed and seizure has been made, no further investigation is necessary therefore he may be enlarged
on bail.

Learned State counsel opposes the submission made by learned counsel for the applicant.

Considering the submission made and the fact that the applicant is in jail since 23.06.2020, chargesheet has been filed, nature of allegation and also the fact that seizure has already been made, I am inclined to release the applicant on bail. Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
