This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant, who has been arrested in connection with Crime No. 168/15, registered at Police Station Excise Circle East, Bilaspur Distt. Bilaspur (C.G.), for the offence punishable under Sections 34(1)(a), 34(2) and 59-A of the Chhattisgarh Excise Act.

After hearing learned counsel appearing for the parties and taking into consideration the facts and circumstances of the case; nature and gravity of offence; quantity of liquor i.e. 270 bulk liters seized from the applicant and further taking into consideration the provisions contained in Section 59-A(ii) of the Chhattisgarh Excise Act, this Court is not inclined to release the applicant on regular bail.

Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected. However, trial Court is directed to conclude the trial expeditiously and decide the case as early as possible preferably within a period of three months from the date of receipt of certified copy of this order. 4.
