Ms. Sunita Jain, Govt. Advocate, for the State. The review petition has been filed seeking review of the order dated 03.01.2019 passed in WPS No. 8418 of 2018.

Contention of the counsel for the petitioner is that inadvertently the writ petition got disposed of in the light of the decision rendered by this Court in the case of Mukesh Kumar Patel & another Vs. State of Chhattisgarh & another decided on 28.11.2017 in WPS No. 2530 of 2017 whereas the case of the petitioner is in fact covered by the judgment of this Court in the case of Shabnum Khatun v. State of Chhattisgarh & Ors. passed in WPS No. 6147/2018. Further contention of the counsel for the petitioner is that the initial appointment of the petitioner was under the Nagar Palika Nigam, Raigarh where she was appointed on 05.12.2011. Subsequently, the petitioner appeared in a fresh selection in Zila Panchayat, Janjgir Champa where she was appointed on 15.12.2017. According to the petitioner, her case is in fact covered by the judgment of this Court passed in the case of Shabnum Khatun v. State of Chhattisgarh & Ors. and not that of Mukesh Kumar Patel which has been reflected in the order dated 03.01.2019 and prays for review of the same.

The facts as narrated by the petitioner are not opposed by the other side.

Accordingly, the review petition is allowed. The order dated 03.01.2019 passed in WPS No. 8418/2018 stands recalled and WPS No. 8418/2018 is ordered to be listed for rehearing today itself. Sd/- (P. Sam Koshy) JUDGE Khatai
