1. Heard.

2. Mr. Sudheer Sahu, learned State counsel submits that the application for grant of anticipatory bail with respect to applicant no. 2 has rendered infructuous as he has been arrested by the police on 25.08.2021.

3. Mr. Anil Gulati, learned counsel for the applicants submits that in view of the submission made by learned State counsel, he is not pressing the application for grant of anticipatory bail with respect to applicant no. 2.

4. In view of the above, application for grant of anticipatory bail with

respect to applicant no. 2/ Santosh Gurung is dismissed as having become infructuous.

5. Mr. Anil Gulati, learned counsel for the applicants seeks permission of this Court to withdraw the bail application with respect to applicant no. 1. However, he submits that a direction be issued to the Court below concerned to consider and decide the application for grant of regular bail, if filed by applicant no. 1/ Gauri Banjare after her surrender, on same day.

6. Learned State counsel submits that he is having no objection to the prayer made by learned counsel for the applicant.

7. Accordingly, bail application with respect to applicant no. 1 is dismissed as withdrawn. In the event, applicant no. 1, after her surrender, files application for grant of regular bail, learned Court below may consider and decide the application, if possible, on same day, in accordance with law.
