As per the report, the applicant is handicapped and he is weak and his yearly income is about Rs. 25,000/- per year. This report is unrebutted, it appears that the applicant is indigent person.
Accordingly, he is exempted from paying court-fees in filing the appeal.
Let this petition be registered under Section 96 of the Code of Civil Procedure, 1908.
Heard on application for condonation of delay in filing the appeal. For the reasons mentioned in the application, the same is allowed and the delay of 170 days in filing the appeal is condoned. Call for the record of trial Court within four weeks. Also heard on admission.
