Shri Satish Gupta, Govt. Advocate Order On Board 09/09/2015 The applicant is apprehending his arrest in connection with Crime No.21/2015 registered at Police Station-Sarangarh, District Raigarh (CG) for alleged commission of offence under Section 406, 409/34 of IPC.

Case of the prosecution is that various public works were executed, in which, huge financial irregularities were committed and during the said period, the applicant was working as the Secretary of Gram Panchayat. 3.
Learned counsel for the applicant submits that as far as present applicant is concerned, merely because, he was posted as Secretary during that particular period under scrutiny and check, it cannot be held that the applicant was also involved in the irregularities. It is submitted that allegations have been leveled without proper valuation and physical verification of the work, scrutiny of bill and payments. 4.
On the other hand, learned State counsel submits that though work was not got done but huge public amount was withdrawn and thus misappropriation.

Taking into consideration the submission of learned counsel for the parties, particularly taking into consideration the role of the applicant in the alleged offence, I am not inclined to grant bail to the applicant. 6.
The application is rejected.
