1. This is a second bail application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.37 of 2020, registered at Police Station Basantpur, District-Rajnandgaon C.G., for the offence punishable under Section 420 of the I.P.C.

2. The first bail application was dismissed by order dated 27.08.2020 in MCRC No.3809 of 2020 on merits.

3. Pursuant to the order dated 06.01.2021 passed in this bail application, the Sessions Judge, Rajnandgaon, concerned JMFC and District Najir have sent their explanation.

4. Perused the same.

5. The concerned JMFC is warned to be careful in future while accepting any amount for deposit in CCD as in the present case such amount was accepted without there being any order of the Court.

6. Learned counsel for the applicant seeks permission of the Court to withdraw the second bail application.

7. Permission granted.
