Kanhaiya Lal Rathore v. R.K.Gupta
NAFR HIGH COURT OF CHHATTISGARH, BILASPUR CONT No. 512 of 2017 • Kanhaiya Lal Rathore S/o Late Harishankar Rathore, Aged About 73 Years R/o Ward No.17, Near Santoshi Mandir, Station Road, Sakti, P. S. and Tahsil Sakti, District JanjgirChampa, Chhattisgarh ---- Petitioner
Versus
• R. K. Gupta, Recovery Officer, Chhattisgarh Co-Operative Societies, Head Office Janjgir, District Janjgir - Champa, Chhattisgarh ---- Respondent For Petitioner Shri Ravindra Sharma, Advocate For Respondent Shri Vinay Pandey, Advocate Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 19/04/2018 1.
A perusal of the document (Annexure-R-5) would demonstrate that the Recovery Officer has passed an order in course of execution of the order granting back wages to the petitioner.
2.
Since the Recovery Officer has made all efforts to recover the dues, but the Primary Society is inactive having no bank accounts or property except a godown leased to a tenant, the rent of which has also been paid to the petitioner, it cannot be said that the Recovery Officer has not made any
effort to execute the order.
3.
The substantial compliance has been made to give effect to the order passed by this Court, therefore, no further action is required in this contempt petition. It is accordingly disposed of. The petitioner would be at liberty to take recourse to any other proceeding as maintainable in law.
