Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 29/10/2020 Heard.
1. The applicant has been arrested in connection with Crime No.289 of 2020 registered at Police Station- Khairagarh, District Rajnandgaon (CG) for the alleged commission of offence under Section 306 of IPC.
2. Prosecution case is that the applicant harassed and subjected his wife to physical and mental cruelty both due to which, she committed suicide.
3. Learned counsel for the applicant would submit that he has been falsely implicated merely because his wife committed suicide in the matrimonial house, it cannot be assumed that the applicant abetted commission of suicide. The allegation of subjecting wife to cruelty is based on a written report said to be lodged by the mother of the deceased and the disclosures made long after the date of incident and FIR registered in the month of August, 2020.
4. On the other hand, learned State counsel opposes and submits that the wife of the applicant committed suicide in the matrimonial house and in
-2the morgue enquiry, itself, the allegation of mental and physical cruelty was made by the mother, brother and other relative of the deceased and on that basis, FIR has been registered.
5. In view of the nature of allegations, material against the applicant and that there are allegation of subjecting wife to physical and mental cruelty due to which, wife committed suicide, it is not a fit case for grant of bail. The bail application is therefore rejected.
