Hon'ble Smt. Justice Rajani Dubey Order On Board 26.11.2020

1. By this CRMP, the petitioner seeks modification of the order dated 01.09.2020 passed in CRMP No. 1057/2020.

2. Vide order dated 01.09.2020 passed in CRMP No. 1057/2020, this Court has granted benefit of regular bail to the petitioner and she was directed to be released on bail on her executing a personal bond in the like sum of Rs. 15,000/- with one local surety in the like sum to the satisfaction of the trial Court.

3. Learned counsel for the petitioner submits that since the petitioner is a resident of Phalbani district located in Odisha state and she is languishing in jail, her family members do not know any residents in Chhattisgarh, therefore, she is unable to furnish local solvent surety. Hence, it is prayed that this Hon'ble Court

may kindly consider the application, modify order dated 01.09.2020 and permit the petitioner to deposit cash security in the Court in lieu of surety in the interest of justice.

4. On due consideration and for the reasons mentioned in the application, the same is allowed. The order dated 01.09.2020, passed in CRMP No. 1057/2020, relating to para 5 be read as " Petitioner is now directed to be released on bail her depositing a sum of Rs.30,000/- in cash as security before the trial Court concerned. She is also directed to file her personal Voter ID and permanent correct address before the trial Court concerned.

5. The trial Court is at liberty to demand any other documents to secure the attendance of the petitioner.

6. Accordingly, the instant petition is modified to the extent indicated hereinabove.
