Present petition has been filed under Section 378(3) of the Code of Criminal Procedure assailing the impugned judgment of acquittal and order dated 15.02.2018 passed by the Special Judge (POCSO Act) , Janjgir district Janjgir-Champa in Special Criminal Case No. 22/2017 whereby the court below has acquitted the accused/respondent of the offence under Section 4 of the Protection of Children from Sexual Offences Act, in alternative under Section 376 IPC, seeking leave to appeal. The application is allowed. The leave as prayed for is granted.
Office is directed to register the case as a regular acquittal appeal.

Issue notice to the respondent on payment of P.F. as per rules. Notice be made returnable in twelve weeks. List the matter for final hearing in due course. Meanwhile, Registry to prepare paper book.
