The applicant has preferred this first bail application under Section 439 of the Code of Criminal Procedure for grant of bail as he is arrested on 05.08.2020 in connection with Crime No.POR No. 14326/05, registered in Police Station Forest Range Pithora District Mahasamund (C.G.) for offence punishable under sections 9, 39, 50 and 51 of the Wild Life Protection Act, 1972.

As per the prosecution case, the applicant with the other co-accused have killed the Bear by erecting illegal live electric wire from a transformer. 3.
Learned counsel for the applicant submit that the bail of the similar coaccused has been allowed by the Coordinate Bench and he also places the order for perusal i.e. MCRC No. 5740/2020.

Learned State counsel do no dispute the fact that the other co-accused have been enlarged on bail.

Considering the fact that that the other co-accused have already been enlarged on bail by the coordinate Bench, I am inclined to release the applicant on bail. Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.50,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed. 6.
