1. By this contempt petition, the petitioner alleges willful disobedience of the order passed by this Court on 3.10.2017 in WPS No.6670 of 2016 by submitting that within the time stipulated by the Court, the petitioner's case for regularization has not been considered.
2. I find from the reply of the respondent that after the order was passed, the petitioner's case was examined by the authority namely Chief Engineer, Mahanadi Godawari Kachhar, Water Resources Department, Raipur and the said authority has, on principle, found that the petitioner is entitled to regularization but as there is no post available in the contingency establishment to regularize the petitioner, a recommendation for creation of supernumerary post has been made on 31.10.2017 to the Engineer-in-Chief of Water Recourses Department with reminder on 7.12.2017.
-23. In view of the above, I am not inclined to continue this contempt petition against respondent-Executive Engineer because he has already done his part towards compliance of the order of the Court.
4. Contempt petition is therefore closed, however, with liberty to the petitioner to take appropriate steps if necessary against those who have not taken appropriate decision towards compliance of the order of the Court. Sd/-/-/--- -- (Manindra Mohan Shrivastava) Judge Praveen
