These three appeals would arise out of the same judgment of conviction and sentence.
CRA No.1071 of 2019 filed by Dhiran Ram and CRA No.1024 of 2019 filed by Ajeet Ram and Smt. Aghanmati have been filed through the High Court Legal Services Committee. The third appeal bearing CRA No.1097 of 2019 has been filed by the convicted accused persons through counsel of their choice, therefore, it is directed that CRA No.1071 of 2019 and CRA No.1024 of 2019 be closed being not necessary.
CRA No.1097 of 2019 is posted in default for the reason that appellants therein have already preferred the above stated two appeals which have now been closed, therefore, this appeal is treated to be duly constituted.
Let name of learned counsels Shri Anil Gulati, Shri Samir Singh and Shri Varunendra Mishra be published alongwith Shri J.K. Saxena,
Advocate, in the cause list in all further dates of hearing of CRA No.1097 of 2019.
Heard learned counsel for the appellants on admission as well as on I.A. No.01 of 2019, application for suspension of sentence and grant of bail.
Admit.
Issue notice to the respondent.
Learned State counsel would accept notice, therefore, P.F. need not be paid. He undertakes to file reply to I.A. No.01 of 2019 within two weeks.
List the matter after 06 weeks.
In the meanwhile, the Registry shall prepare paper book in accordance with rules within 15 days, however, two additional sets of paper book shall be prepared for use of Shri Anil Gulati and Shri Varunendra Mishra, counsels for respective appellants. Record of the trial Court be summoned.
Post the matter for consideration in the week commencing 19.08.2019.
In the meanwhile, State shall file reply to I.A. No. 01 of 2019. SD/- SD/- (Prashant Kumar Mishra) (Gautam Chourdiya) Judge Judge Ayushi
