(1) The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during trial in connection with Crime No. 227/2014 registered at Police Station Rajim, District Gariyaband for the offences punishable under Sections 457, 380, 511 & 427 of Indian Penal Code and Sections 3 & 4 of the Prevention of Damage to Public Property Act, 1984. (2) After hearing learned counsel for the parties and taking into consideration the facts & circumstances of the case and the
manner in which applicant and other co-accused persons are said to have damaged ATM machine owned by State Bank of India and caused loss of Rs. 5,00,000/- and also got burnt the Indian currency, I am not inclined to release the applicant on bail. Thus, the bail application is rejected. However, the trial Court is directed to expedite the trial.
