ORDER

(Passed on 11th September, 2021) 1.

The contesting parties to this appeal have amicably settled/compromised the dispute, which is subject matter of this appeal, voluntarily. We have also found that the terms and conditions of compromise/settlement arrived at between the contesting parties are just, proper and legal. There is no legal impediment to compromise and hence are acceptable.

We accordingly accept the compromise/settlement, proposed by the parties and order that the appellant shall pay Rs.25,47,443/- (Rupees Twenty Five lakhs Forty Seven Thousands Four Hundred and Forty Three only) to respondent No.1 by way of compensation within one week through cheque. In case the amount is not paid within stipulated time then the interest @ 9% per annum from the date of passing of this compromise award shall also be payable till its realization.

The first appeal is disposed off on the terms settled between the parties. 3.

In view of the provisions contained in Section 21 of the Legal Services Authority Act, 1987, the court fee paid by the appellant shall be refunded as per the manner provided under the Court Fees Act, 1870.
