Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 31/08/2016 The petitioner's grievance is that the representation for upgradation of his grade from 'x' to '[k' as per circular dated 03/06/2015 (Annexure P/13) has remained pending before the Director and the petitioner apprehends that if the remarks are not suitably modified, at the end of probation period, adverse decision may be taken against him.

Representation has been made by the petitioner on 18/07/2016. It is found that the extension period of probation has also come to an end. Therefore, in these circumstances, it would be fair that before taking decision with regard to petitioner's confirmation in service, representation dated 18/07/2016 be first decided by the Director, so that, at the time of consideration of his case for confirmation, gradation considered by the Director is acted upon. The Director may take decision within a period of 45 days from today.
