Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 29/08/2016 Heard on admission.
1. This petition has been filed by the petitioner seeking indulgence of the Court against the transfer order on the ground that the petitioner is suffering from bone cancer and requires constant treatment at Bilaspur which is very near from the present place of posting. By the impugned order, the petitioner is being transferred to Janjgir-Naila, which is at a distance of about 75 k.m. from Bilaspur.
2. Though the transfer order results in some more distance of the place of posting from Bilaspur where the petitioner claims to be receiving treatment, considering
-2that the petitioner is suffering from deadly disease, respondent may explore the possibility to post the petitioner at nearby station to facilitate proper treatment.
3. If the petitioner moves a representation within a period of 15 days, the same shall be considered and decided by the competent/transferring authority within a period of 4 weeks from the date of receipt of the representation.
4. For a period of 6 weeks, no coercive steps shall be taken against the petitioner.
